SAN FRANCISCO – A tenant alleges its landlords breached their lease agreement.
Jessie Street Collective LLC, doing business as Bloom Room, filed a complaint on March 29 in the San Francisco County Superior Court against Stanley Chia, Elizabeth Wu, Echo Qi, Thu Vu, Tin P. Nguyen, Joe Ovsep Karapetyan, Henry Leref Phan, Brian Russ Wong and Does 1-100 alleging breach of contract and other counts.
According to the complaint, the plaintiff acquired a lease from Med Thrive in 2012 for the defendant's property for the operation of a medical marijuana dispensary. The plaintiff holds Chia, Wu, Qi, TVu, Nguyen, Karapetyan, Phan, Wong and Does 1-100 responsible because the defendants allegedly breached the lease terms by failing to negotiate and agree upon a fair rental market value for the property when the plaintiff wished for an extension period.
The plaintiff seeks actual damages and/or restitution; general, special, punitive damages; statutory penalties; all legal fees and any other relief as the court deems just. It is represented by Yosef Peretz and Sumy Kim of Peretz & Associates in San Francisco.
