SAN FRANCISCO – A California corporation alleges a law firm failed to comply with its duties.
BuenoFrio Inc. and Ignacio Gutierrez filed a complaint on March 29 in the San Francisco County Superior Court against Niesar & Vestal LLP, Gerald Niesar; Oscar Escobar and Does 1 through 50 alleging professional negligence, breach of fiduciary duty, unfair business practices and other counts.
According to the complaint, the plaintiffs consulted the defendants on legal matters relating to their business. The plaintiffs holds Niesar & Vestal LLP, Niesar, Escobar and Does 1 through 50 responsible because the defendants allegedly breached their duty to the plaintiffs by failing to release complete client files at their request.
The plaintiffs request a trial by jury and seek compensatory and general damages, special damages, all legal fees, punitive and exemplary damages, and any other relief as the court deems just. They are represented by Port J. Parker and Kyle A. Wende of Radoslovich Parker Turner, PC in Sacramento.
