San Francisco County man alleged to have breached partnership

SAN FRANCISCO – A Marin County individual is accusing a San Francisco County man of failure to pay.

Gary Mitchell filed a complaint on March 29 in the San Francisco County Superior Court against Steven Brattesani and Does 1 through 100 alleging unjust enrichment, breach of partnership agreement and other counts.

According to the complaint, the plaintiff alleges that he and the defendant were part of the 3309 Fillmore Street Partnership, which commenced in 1999. The suit states the defendant and the plaintiff agreed to a written promissory note for $180,000 in 2003 and that the defendant agreed to pay the sum back no later than December 2008. The defendant allegedly agreed to use his interest in the partnership as security for the note. The plaintiff alleges the note has not been paid in full, and also alleges the defendant has failed to pay rent in full.

The plaintiff seeks dissolution of the partnership, restitution, general damages, special damages, all legal fees, and any other relief as this court deems just. He is represented by Houman Chitsaz of Nardell Chitsaz & Associates LLP in San Rafael.
