Individuals claim they were not paid after almond harvest

FRESNO – A Fresno County couple claim they were not paid for an almond harvest as agreed upon.

Roger Stockton and Ann Stockton filed a complaint on April 6 in the Fresno County Superior Court against Brad Duinkerken, Stevie Duinkerken, Billie Duinkerken, Duinkerken Farms, et al. alleging breach of contract and other counts.

According to the complaint, the plaintiffs allege that in February 2006, the entered into an oral agreement with the defendants that the plaintiffs would prepay them to harvest almonds in exchange for the defendants to harvest and sell the almonds and remit the entire proceeds to the plaintiffs. The plaintiffs hold Brad Duinkerken, Stevie Duinkerken, Billie Duinkerken, Duinkerken Farms, et al. responsible because the defendants allegedly failed to remit the proceeds of the harvest to the plaintiff. They allege they have suffered damages of $178,340.

The plaintiffs seek compensatory damages, interest, punitive and exemplary damages, all legal fees and any other relief as the court deems just. They are represented by Richard C. Conway, Jan L. Kahn and Josh T. Fox of Kahn, Soares & Conway LLP in Hanford.
