SAN FRANCISCO – A San Jose business alleges that a Massachusetts corporation unlawfully copied morale patches.
Mil-Spec Monkey Inc. and Clayton Montgomery filed a complaint on April 20 in the U.S. District Court for the Northern District of California against Celidon Patch Inc. and Albert J. Kane alleging copyright infringement.
According to the complaint, the plaintiffs allege that they suffered damages from having their copyrighted designs copied. The plaintiffs hold Celidon Patch Inc. and Kane responsible because the defendants allegedly made unauthorized replicas of plaintiff's patches and sold them to consumers through eBay.
The plaintiffs request a trial by jury and seek injunction against the defendants, impoundment of all copies of plaintiff's designs, actual damages and profits, statutory damages no less than $150,000, all legal fees, and any other relief as the court deems just.
