Couple claims improperly constructed retaining wall threatens property

SAN FRANCISCO – Property owners claim they have been damaged from the negligent construction of a retaining wall.

Christine Yee and Clifford Yee filed a complaint on April 3 in the San Francisco County Superior Court against Kauri Hills LLC, Ashbury General Contracting and Engineering, John Stark  Casey, Sabrina Lui Casey, 1230 Jackson Street LLC and Does 1 through 500 alleging negligence, nuisance, trespass and other counts.

According to the complaint, the plaintiffs allege that the defendants constructed a retaining wall adjacent to their property. The plaintiffs holds Kauri Hills LLC, Ashbury General Contracting and Engineering, Stark Casey, Lui Casey, 1230 Jackson Street LLC and Does 1 through 500 responsible because the defendants allegedly failed to properly construct the retaining wall, which poses a threat of landslide to the plaintiffs' property. They allege they have had to pay to construct bracing of the wall and have not been compensated.

The plaintiffs seek damages, interest, order the defendants to replace the retaining wall at their cost, injunctive relief, general damages, all legal fees and any other relief as the court deems just. They are represented by James A. Lassart and Adrian G. Driscoll of Murphy, Pearson, Bradley & Feeney in San Francisco.
