SAN FRANCISCO – A San Francisco individual alleges his former employer transferred assets while litigation against him was pending in order to avoid the enforcement of a judgment.
Anton Goncharuk filed a complaint on April 3 in the San Francisco County Superior Court against Bursa Restaurant Inc. and Does 1 through 25 alleging avoidance of fraudulent transfer.
According to the complaint, the plaintiff was a former employee of Ahmed Elsakar and filed a suit against him in 2015 over allegations of unpaid overtime and other wage law violations. The suit states Elsaker agreed to pay $75,000 to plaintiff in 2016 in installments of $2,759 monthly payments. The plaintiff alleges Elsaker defaulted on the settlement.
The plaintiff holds Bursa Restaurant Inc. and Does 1 through 25 responsible because Elsaker allegedly transferred assets of his Bursa Restaurant in order to avoid plaintiff's collection efforts.
The plaintiff seeks an order to reverse the transfer of the Bursa assets for plaintiff's benefits, all legal fees, interest and any other relief as the court deems just. He is represented by Alexei Kuchinsky and William P. Klein of Klein law Group in San Francisco.
