Woman claims late husband's exposure to substances at Union Pacific Railroad Co. caused damage

OAKLAND – An Idaho widow alleges her husband was exposed to toxic substances that contributed to him developing leukemia.

Jody Lafferty, individually and as the personal representative of the estate of Patrick Lafferty, filed a complaint on April 24 in the U.S. District Court for the Northern District of California, Oakland Division against Union Pacific Railroad Co. alleging negligence.

According to the complaint, Patrick Lafferty was employed by the defendant as an brakeman/conductor and/or engineer and was exposed to toxic substances and carcinogens that contributed to him developing leukemia.

The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly failed to provide a safe place to work, failed to take action to minimize or eliminate the expose to toxic materials and other counts.

The plaintiff seeks damages of more than $150,000 plus all legal fees. She is represented by Dale Ratner of Marc J. Bern & Partners in San Francisco.
