Advanced Tile alleged to owe more than $9,000 to labor union funds

SAN FRANCISCO – A Rancho Cordova employer is accused of failing to pay employee contributions.

Board of trustees of the Northern California Tile Industry Welfare Fund; board of trustees of the Northern California Tile Industry Pension Trust Fund; et al. filed a complaint on April 26 in the U.S. District Court for the Northern District of California against Don Silva, individually and doing business as Advanced Tile, alleging violation of the Employee Retirement Income Security Act and the Labor Management Relations Act.

According to the complaint, the plaintiffs allege that they have suffered damages due to unpaid and late-paid contributions. The plaintiffs holds Silva, individually and doing business as Advanced Tile, responsible because the defendant allegedly breached his bargaining agreement with the plaintiffs by refusing to make monthly payments on behalf of his employees.

The plaintiffs seek sum of $9,849.87, plus interest at the contract rate of 10 percent, all legal fees and any other relief as this court deems just. They are represented by Lori A. Nord of Kraw Law Group APC in Mountain View.
