SACRAMENTO – A Sacramento consumer alleges a debt collector harassed her with phone calls.
Toni Robinson filed a complaint on April 26 in the U.S. District Court for the Eastern District of California against D. Scott Carruthers alleging violation of the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that an alleged debt was assigned to the defendant for collection and that the defendant began contacting her in September 2016. She alleges the defendant also contacted her boyfriend and disclosed the debt and called her at work.
The plaintiff holds D. Scott Carruthers responsible because the defendant allegedly disclosed the alleged debt to a third party without her permission and contacted her at work without her permission.
The plaintiff requests a trial by jury and seeks statutory damages of $1,000, all legal fees, actual damages, and any other relief as the court deems just. She is represented by Crosby S. Connolly and Robert L. Hyde of Hyde & Swigart in San Diego.
