SACRAMENTO – A Carmichael consumer claims she was annoyed and harassed by calls from a financial institution.
Carlotta Farris filed a complaint on April 26 in the U.S. District Court for the Eastern District of California against Capital One Bank alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that she suffered damages from receiving several collection calls from the defendant regarding an alleged credit card debt. The plaintiff holds Capital One Bank responsible because the defendant allegedly called the plaintiff on her cellphone at least 106 times after she requested the calls stop in March.
The plaintiff seeks statutory damages, all legal fees and any other relief as the court deems just. She is represented by Taylor M. Tieman of Krohn & Moss LTD in Manhattan Beach.
