Pinnacle Grinding and Grooving alleges it was not paid for work on Highway 70

SACRAMENTO – A subcontractor alleges it was not paid for work it completed on a federal highway project.

United States of America, for the use and benefit of Pinnacle Grinding and Grooving LLC, filed a complaint on April 26 in the U.S. District Court for the Eastern District of California against DigIt Construction, Inc., Travelers Casualty and Surety Co. of America and Does 1-10 citing breach of contract and other counts.

According to the complaint, DigIt was awarded a federal contract for the repair of Highway 70 near Portola in Plumas County. The suit states Pinnacle was subcontracted for the project in August 2016. The plaintiff holds DigIt Construction, Inc., Travelers Casualty and Surety Company of America and Does 1-10 responsible because the defendants allegedly failed to pay Pinnacle for labor and materials provided for their project.

The plaintiff seeks the sum of $24,891.25, interest, all legal fees and any other relief as the court deems just. It is represented by Matthew J. Weber and Sean J. Filippini of Downey Brand LLP in Sacramento.
