LOS ANGELES – A United Kingdom-based photographer with a subsidiary in Beverly Hills alleges television personality Khloe Kardashian unlawfully used one of its photos.
Xposure Photos (UK) LTD filed a complaint on April 25 in the U.S. District Court for the Central District of California against Khloe Kardashian and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff is the copyright owner of an image of Kardashian and one of her sisters dining at a Miami restaurant. The plaintiff holds Kardashian and Does 1 through 10 responsible because the defendant allegedly copied plaintiff's photograph and posted it on Instagram in 2016 without a license. The plaintiff alleges the photo was altered to remove the copyright management information.
The plaintiff requests a trial by jury and seeks injunction against the defendant, profits and damages, impoundment of all copies of plaintiff's photographs, actual damages, profits, statutory damages of not less than $2,500 or more than $25,000, interest, all legal fees and any other relief as the court deems just.
