Woman alleges Metropolitan Life wrongfully denied benefits claim

LOS ANGELES – A Riverside County resident claims that her claim for disability benefits was unlawfully denied.

Giselle Simonian filed a complaint on April 24 in the U.S. District Court for the Central District of California against Metropolitan Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in June 2015, she became disabled and applied for disability benefits and was denied in March 2016. The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant allegedly denied her claim for disability benefits without ever conducting an independent medical exam.

The plaintiff seeks payment of disability benefits at the rate of $4,620 per month, interest, all legal fees and any other relief as the court deems just. She is represented by Bernard R. Schwam of Law Office of Bernard R. Schwam in Encino.
