Individuals allege Bank of America misplaced deed

SAN FRANCISCO – Three individuals allege that a bank drilled into their safe deposit box and misplaced a deed.

Kwong Ah Chen, Jie X Peng and Wenjie Chen filed a complaint on April 4 in the San Francisco County Superior Court against Bank of America, NA and Does 1-20 alleging breach of implied covenant of good faith and fair dealing, conversion and negligence.

According to the complaint, the plaintiffs rented a safe deposit box from the defendant at its Elk Grove location and paid the rent each year. The plaintiffs allege they received a letter in 2016 stating that the defendants had drilled open the box and shipped its contents elsewhere. The suit states that when the contents were returned, a deed to a property in China was missing.

The plaintiffs holds Bank of America NA and Does 1-20 responsible because the defendants allegedly failed to inform the plaintiffs that they drilled their box, shipped its contents without any notice and denied the claim for the missing deed.

The plaintiffs request a trial by jury and seek compensatory damages including the value of the real property that cannot be recovered without the original deed (approximately $129,412), punitive and exemplary damages, all legal fees and any other relief as the court deems just. They are represented by John A. Kithas, Christopher Land and Qianli Yang of Law Offices of John A. Kithas in San Francisco.
