FRESNO – A Fresno County corporation alleges a Merced County corporation failed to pay it for its work on a construction project.

Prousys Inc. filed a complaint on April 19 in the Fresno County Superior Court against Clark Bros. Inc., city of Fresno, Travelers Casualty and Surety Co. of America Inc. and Does 1-25 alleging breach of contract and other counts.

According to the complaint, the city of Fresno contracted Clark Bros. in April 2016 as the general contractor for the construction of a recycled water pump station. The plaintiff was a subcontractor on the project and finished its work in February, the suit states.

The plaintiff holds Clark Bros. Inc., city of Fresno; Travelers Casualty and Surety Co. of America Inc. and Does 1-25 responsible because the defendants allegedly breached their contractual agreement by failing to pay the plaintiff after the completion of the project.

The plaintiff seeks the amount of $173,200.14 plus interest, all legal fees and any other relief as the court deems just. It is represented by Andrew K. Sheffield of LeBeau-Thelen LLP in Bakersfield.
