SAN FRANCISCO – An individual claims that a business failed to put appropriate warnings on its products regarding a certain chemical.

John Moore filed a complaint on April 7 in the San Francisco County Superior Court against Green Leaf Inc. and Does 1-150 citing the state's Occupational Safety Health Act.

According to the complaint, the defendant manufactures vinyl/PVC wires and vinyl/PVC ball value grips that have the chemical di(2-dethylheyl)phthalate (DEHP) present in them. The suit states California lists DEHP as a chemical known to cause birth defects and other reproductive harm.  The plaintiff holds Green Leaf Inc. and Does 1-150 responsible because the defendants allegedly failed to provide a clear warning to consumers regarding the health hazards of being exposed to DEHP per state regulations.

The plaintiff seeks damages in the amount of $2,500 per day per violation, enjoin the defendant from manufacturing and distribution of their products without warning, all legal fees and any other relief as this court deems just. He is represented by Clifford A. Chanler and Christopher Tuttle of The Chanler Group in Berkeley.
