Co-signer alleges credit was damaged because of failure to pay student loan

SAN FRANCISCO – A San Francisco man alleges that a Solano County individual failed to make payments on a student loan and damaged his credit.

Donald Carmignani filed a complaint on April 12 in the San Francisco County Superior Court against Kenneth Groen, Does 1-10 alleging breach of contract and negligence.

According to the complaint, the plaintiff co-signed for student loan for the defendant in 2007. The plaintiff holds Groen and Does 1-10 responsible because the defendants allegedly failed to make timely payments on the loan and the plaintiff's credit rating has been damaged as a result.

The plaintiff requests a trial by jury and seeks special damages of $28,278.50, general damages of $20,000, all legal fees, and any other relief as the court deems just. He is represented by Michael McCloskey of Michael McCloskey in San Francisco.
