Woman alleges San Francisco apartment had rodent infestation

SAN FRANCISCO – A tenant is suing her former landlord and others over conditions in the apartment she alleges threatened her health and safety.

Katrina Berman filed a complaint on April 10 in the San Francisco County Superior Court against Carol Ruth Silver, individually and as trustee of the Carol Ruth Silver  Revised Revocable Family Trust, Horneff-Waddle Corp., doing business as  Property Management Systems, and Does 1 through 50 alleging nuisance, breach of contract, wrongful eviction and other counts.

According to the complaint, the plaintiff rented 3434 California Street, Unit No. 4, in San Francisco from Silver. The plaintiff alleges the apartment was not in compliance with state law. The plaintiff holds Silver, Horneff-Waddle Corp. and Does 1 through 50 responsible because the defendants allegedly failed to provide a habitable dwelling, allowed leaks and excessive dampness to damage walls and refusing to remediate the rodent infestation.

The plaintiff requests a trial by jury and seeks general damages, special damages, punitive damages, all legal fees and any other relief as the court deems just. She is represented by Eric L. Lifschitz, Aaron H. Darsky and Nghi T. Lam of Law Offices of Eric L. Lifschitz in San Francisco.
