SAN FRANCISCO – A cabinet maker alleges that his former employers failed to pay the correct rate for overtime wages.
Oswaldo Cruz filed a complaint on May 3 in the U.S. District Court for the Northern District of California against Built-in C & C Inc.; Niviya Inc.; Hyung Ki Han, also known as Young K Han; and Mina Han, also known as Mi OK Han, citing the Fair Labor Standards Act and California labor codes.
According to the complaint, the plaintiff alleges that he worked for the defendants from July 2013 to October 2016. The plaintiff holds the defendants responsible because the defendants allegedly failed to pay premium wages to the plaintiff for working more than 40 hours per week, failed to provide meal and rest breaks and failed to provide an itemized wage statement.
The plaintiff seeks compensatory damages, unpaid wages, premium wages for meal and rest break violations, interest of 10 percent of the unpaid wages and overtime compensation, waiting time penalties, all legal fees and any other relief as this court deems just.
