Man claims Ocwen Mortgage Servicing, Ocwen Loan Servicing called him more than 1,000 times

SAN FRANCISCO – A San Ramon man alleges that he has unlawfully received 1,403 calls from a mortgage company.

Gregory Franklin filed a complaint on May 10 in the U.S. District Court for the Northern District of California against Ocwen Mortgage Servicing Inc. and Ocwen Loan Servicing LLC citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that between 2011 and 2015, he suffered damages from receiving several collection calls from the defendants. The plaintiff holds Ocwen Mortgage Servicing Inc. and Ocwen Loan Servicing, LLC responsible because the defendants allegedly kept on calling the plaintiff despite his request to stop calling and used an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks statutory damages; injunctive relief; special, general, compensatory, and punitive damages; and any other relief as the court deems just. He is represented by Joshua B. Swigart and Veronica E. McKnight of Hyde & Swigart in San Diego.
