Consumer claims Cadillac has defects in engine, suspension

SAN FRANCISCO – A San Francisco individual alleges a vehicle she purchased has defects and seeks rescission of the purchase contract.

Valentina Nicholas filed a complaint on April 19 in the San Francisco County Superior Court against General Motors LLC and Does 1 through 10 citing the Song-Beverly Act.

According to the complaint, the plaintiff alleges that she purchased a 2013 Cadillac ATS in April 2014 that was delivered with serious defects and nonconformities to warranty, including defects in its engine, suspension, HVAC and electrical systems. The plaintiff holds General Motors LLC and Does 1 through 10 responsible because the defendants allegedly failed to fix the defects of the vehicle they sold to the plaintiff.

The plaintiff seeks general, special and actual damages, rescission of the purchase contract and restitution, incidental and consequential damages, actual damages, interest, all legal fees and any other relief as the court deems just. She is represented by Steve Mikhov of Knight Law Group LLP in Los Angeles.
