Former Kohl's cashier alleges she was not provided seating during her employment

SAN FRANCISCO – A former cashier for a department store alleges employees were unlawfully not provided seating while working.

Clarissa Duke filed a complaint on behalf of other aggrieved employees on April 18 in the San Francisco County Superior Court against Kohl's Department Stores Inc. and Does 1 through 10 citing California Labor Code and the Private Attorneys General Act.

According to the complaint, the plaintiff alleges that she worked as a cashier for the defendant from September 2016 to February 2017 at its Upland location. The plaintiff holds Kohl's Department Stores Inc. and Does 1 through 10 responsible because the defendants allegedly refused to provide proper seating to the plaintiff during her employment.

The plaintiff requests a trial by jury and seeks civil penalties of $25,000, all legal fees, interest and any other relief as the court deems just. She is represented by Andrew J. Sokolowski, Jennifer R. Bagosy and Suzy E. Lee of Capstone Law APC in Los Angeles.
