Man alleges eye injury rendered him disabled, Metropolitan Life wrongfully denied benefits

OAKLAND – A Marin County man and employee of Morgan Stanley & Co. alleges his claim for disability benefits was wrongfully denied by his insurer.

Michael Fitz-Gerald filed a complaint on May 25 in the U.S. District Court for the Northern District of California against Metropolitan Life Insurance Co. and Does 1 to 10 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled due to the loss of sight in one eye, applied for disability benefits and was denied by the defendants in September 2016. 

The plaintiff seeks all plan benefits due and owing to the plaintiff, all legal fees, interest and any other relief as the court deems just. He is represented by Robert J. McKennon, Joseph S. McMillen and Stephanie L. Talavera of McKennon Law Group PC in Newport Beach.
