Consumer claims Simon's Agency Inc. keeps calling after she revoked consent

LOS ANGELES – A Hermosa Beach individual claims a debt collector called her at an excessive and harassing rate.

Allison Brown filed a complaint on May 22 in the U.S. District Court for the Central District of California, Western Division against Simon's Agency Inc. citing the Telephone Consumer Protection Act, the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in 2016, she told a representative of the defendant to stop calling her in its attempt to collect an alleged debt. The plaintiff holds Simon's Agency Inc. responsible because the defendant allegedly kept on calling the plaintiff despite her request to stop calling and used an automatic telephone dialing system to place the calls.

The plaintiff requests a trial by jury and seeks statutory damages of $500, treble damages, actual damages, statutory damages of $1,000, punitive damages, all legal fees and any other relief as the court deems just. She is represented by Trinette G. Kent of Lemberg Law LLC in Wilton, Connecticut.
