Labor union seeks audit of Borgerson's Arizona Floors

LOS ANGELES – A company engaged in the construction industry in Arizona is accused of failing to allow an audit.

Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trusts filed a complaint on May 22 in the U.S. District Court for the Central District of California against Borgerson's Arizona Floors and Does 1 through 10 citing the Labor-Management Relations Act and the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the parties entered into an agreement in 2014 that permits the plaintiffs to conduct audits. The plaintiffs holds Borgerson's Arizona Floor and Does 1 through 10 responsible because the defendants allegedly breached their bargaining agreement with the plaintiff by failing or refusing to allow the plaintiffs to conduct an audit of its business records.

The plaintiffs seek for the defendants submit a completion of an audit, all legal fees and any other relief as the court deems just. They are represented by Jodi Siegner of DeCarlo & Shanley in Los Angeles.
