Current, former tenants of Fresno property allege it has inadequate sanitation

FRESNO – Tenants of a Fresno apartment complex allege that the owner has failed to make needed repairs.

Josefina Flores and Angela Watley filed a complaint on May 8 in the Fresno County Superior Court against Zaid Altahan and Does 1-50 alleging failure to provide a habitable dwelling, nuisance, negligence and other counts.

According to the complaint, Flores resided at the property from 2012 to April 2016 and Watley still currently resides there. They allege the property has inadequate sanitation, lack of adequate heating, insect or rodent infestation and other issues.

The plaintiffs holds Altahan and Does 1-50 responsible because the defendants allegedly failed to provide a quiet enjoyment and possession of the property, refused to repair the property as requested and threatened and harassed and intimidated plaintiffs whenever they complain about the condition of the property.

The plaintiffs seek all damages in an amount to be determined at trial, attorney’s fees, costs of suit and such other just and proper relief. They are represented by Margaret Elder and Chandra Gehri Spencer of Elder & Spencer LLP in Fresno.
