TDW Construction Inc. alleged to owe more than $19,000 for union contributions

SAN FRANCISCO – An employer is alleged to have failed to pay contributions to labor unions in the state.

The board of trustees in their capacities as trustees of the Laborers Health and Welfare Trust Fund for Northern California, et al. filed a complaint on June 2 in the U.S. District Court for the Northern District of California against TDW Construction Inc. alleging breach of contract.

According to the complaint, the plaintiffs allege that they suffered damages from unpaid and late-paid contributions. The plaintiffs hold TDW Construction Inc. responsible because the defendant allegedly breached its agreement with the plaintiff by not paying its benefit contribution on behalf of their employees in a timely manner.

The plaintiffs seek payment of contributions in the amount of $19,798.56; liquidated damages of $9,961.18; liquidated damages and interest in the amount of $13,100.84; actual damages; order the defendant to submit to an audit; all legal fees and any other relief as the court deems just. They are represented by Barry E. Hinkle, Concepcion E. Lozano-Batista, Tracy L. Mainguy and Ryan B. Kadevari of Weinberg, Roger & Rosenfeld in Alameda.
