Color Image Apparel claims Moto Legging design was unlawfully used

SAN FRANCISCO – A Commerce athletic wear designer alleges that the associates of a Florida business have unlawfully used its patented legging design.

Color Image Apparel Inc. filed a complaint on May 30 in the U.S. District Court for the Central District of California against Anual Jackson, Fitgirls_Inspire and Does 1 through 10 alleging patent and trade dress infringement.

According to the complaint, the plaintiff alleges that it suffered damages from having its Moto Legging design copied. The plaintiff holds Jackson, Fitgirls_Inspire and Does 1 through 10 responsible because the defendants allegedly copied plaintiff's distinctive garment designs without its authority.

The plaintiff seeks payment all damages, to enjoin the defendants, profit, all legal fees, punitive damages, and any other relief as the court deems just. It is represented by Michael Adams and Benjamin Deming of Rutan & Tucker LLP in Costa Mesa.
