Couple claims Paul H. Gesswein Co. failed to pay settlement agreement

SAN FRANCISCO – A Los Angeles County couple alleges a Connecticut company has failed to honor a settlement agreement.

Michael Spielman and Loretta Spielman filed a complaint on May 30 in the U.S. District Court for the Central District of California, Western Division against Paul H. Gesswein Co. Inc. alleging breach of contract.

According to the complaint, the plaintiffs and defendants entered into a settlement agreement in April, which stated that payment of the settlement funds was to be made no later than 30 days after the plaintiffs returned the compromise and release. The Spielmans allege that Michael Spielmant is terminally ill and that his disease was caused by the defendant.

The plaintiffs hold Paul H. Gesswein Co. Inc. responsible because the defendant allegedly breached their contractual agreement by not paying the plaintiffs their compensation as ordered by the court.

The plaintiffs seek payment of the outstanding portion of the agreed settlement sum, all legal fees, interest and any other relief as the court deems just. They are represented by Paul R. Kiesel of Kiesel Law LLP in Beverly Hills and by attorneys of Baron & Budd in Dallas, Texas.
