LOS ANGELES – A Los Angeles County corporation alleges that a two-dimensional artwork it created for textile design was used without authorization.
Novelty Textiles Inc. filed a complaint on May 30 in the U.S. District Court for the Central District of California against Trac Wholesale Clothing, Gstage Love.com Inc. and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages from having its 3676 design copied without its consent. The plaintiff holds Trac Wholesale Clothing, Gstage Love.com Inc. and Does 1 through 10 responsible because the defendants allegedly sold fabrics that bear plaintiff's design.
The plaintiff seeks to enjoin the defendant, profits, damages, statutory damages, all legal fees, interest and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
