LOS ANGELES – A medical corporation in the state alleges it was paid at a reduced rate to treatment it provided to a patient.
Culver City Surgical Specialists filed a complaint on May 18 in the U.S. District Court for the Central District of California against Laird Plastics Inc. and Laird Plastics Health Plan alleging that they violated the Employee Retirement Income Security Act and breach of contract.
According to the complaint, the plaintiff provided medical treatment to a patient who was covered by the defendants' plan in 2016. The plaintiff alleges that it verified that the plan would provide coverage for administering the treatment. The suit states that the plaintiff submitted the claim information, but the claim was paid at a reduced rate.
The plaintiff holds Laird Plastics Inc. and Laird Plastics Health Plan responsible because the defendants allegedly failed and refused to produce the requested documents and failed to provide a full and fair review of plaintiff's claim.
The plaintiff requests a trial by jury and seeks an order compelling defendants to produce all documents requested, award for compensatory damages, interest, costs for this action and such other and further relief. It is represented by Bradley E. Jewett of Jewett Law PC in Los Angeles.
