Consumer seeks rescission of vehicle because of allegedly defective Takata airbags

FRESNO – A Visalia consumer is seeking the rescission of the purchase of a Honda vehicle because of its allegedly defective airbags.

Josefina Alvarez filed a complaint on May 11 in the Fresno County Superior Court against American Honda Motor Co. alleging violation of the Consumer Legal Remedies Act and other counts.

According to the complaint, the plaintiff purchased a 2009 Honda CR-V in 2009 and that the vehicle was equipped with a defective Takata airbag. The suit states she took the vehicle in to an authorized service representative for the replacement of the airbags. The subject vehicle substantially impaired its use, value and safety. The plaintiff holds American Honda Motor Co. responsible because the defendant and its representative have failed to return the vehicle back to the defendant in conformance with its warranties.

The plaintiff requests a trial by jury and seeks rescission of the purchase contract and restitution of all monies expended, award for incidental and consequential damages, plus interest, penalties, attorney's fees and costs and all other just and equitable relief.
