KeHe Distributors Inc. alleged to have not properly calculated overtime pay rate

SACRAMENTO – A man employed in San Joaquin County alleges that his employer failed to correctly calculate the rate for overtime.

Stephen Russell filed a complaint on June 6 in the U.S. District Court for the Eastern District of California against KeHe Distributors Inc. and Does 1-100 alleging violation of state labor codes.

According to the complaint, the plaintiff alleges that he was hired by the defendant in January 2016. The plaintiff holds KeHe Distributors Inc. and Does 1-100 responsible because the defendants allegedly failed to include commissions, certain bonuses and other items of compensation when calculating the rate for overtime pay.

The plaintiff requests a trial by jury and seeks actual, compensatory, special and general damages; injunctive relief, penalties and liquidated damages; statutory attorneys’ fees and costs; all legal fees; interest; and any other relief the court grants. He is represented by Robert J. Wasserman, William J. Gorham, Nicholas J. Scardigli and John P. Briscoe of Mayall Hurley P.C. in Stockton.
