Labroots accused of unlawfully using New York man's photograph

LOS ANGELES – A Yorba Linda corporation is alleged to have used a photograph without permission.

Andrew Paul Leonard filed a complaint on June 7 in the U.S. District Court for the Central District of California against Labroots Inc. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that he suffered damages from having his "Scanning Electron Microscopy of Human Bone Marrow Stem Cells 4" image used without permission. The plaintiff holds Labroots Inc. and Does 1 through 10 responsible because the defendants allegedly publicly displayed plaintiff's two-dimensional image without his consent.

The plaintiff requests a trial by jury and seeks enjoin the defendant, statutory damages, all legal fees, interest, and any other relief as the court deems just. He is represented by Stephen M. Doniger, Scott A. Burroughs and Howard S. Han of Doniger/Burroughs in Venice.
