Physician assistant alleges she was subjected to retaliation by UrgencyMed

FRESNO – A physician's assistant residing in Fresno County alleges she was terminated shortly after she reported purportedly illegal practices.

Carol A. Devito filed a complaint on May 19 in the Fresno County Superior Court against Monterey Peninsula Orthopaedic and Sports Medicine Institute; UrgencyMed and Does 1 through 10, inclusive alleging breach of contract 

According to the complaint, the plaintiff alleges that on March 17, 2016, plaintiff and the defendants entered into a three-year employment contract for a position as a physician's assistant at UrgencyMed. The suit states she began working for the defendants on June 1, 2016.

While employed by the defendants, the plaintiff alleges she discovered illegal charting and billing practices and reported these issues in July 2016. On Aug. 29, 2016, she was terminated from her employment, the suit states.

The plaintiff holds the defendants responsible because they allegedly failed to provide 30 days' notice prior to the termination, failed to provide two months' severance payment upon plaintiff's termination as required by the contract's term and retaliated against her for reporting the purportedly illegal practices.

The plaintiff seeks damages, plus costs of suit, prejudgment interest, attorneys' fees, and for such other and further relief as the court deems just and proper. She is represented by Jay A. Christofferson of Wanger Jones Helsley PC in Fresno.
