Man accuses The Enclave Apartment Homes Trinity Property Consultants of defamation

FRESNO – A Fresno County man alleges that an apartment complex damaged his credit score.

Hussein Ali filed a complaint on May 22 in the Fresno County Superior Court against The Enclave Apartment Homes Trinity Property Consultants alleging that the defendant violated the Fair Credit Reporting Act, defamation and other counts.

According to the complaint, the plaintiff alleges that in February, he applied for an apartment at the defendant's complex and provided a deposit and a credit application. The suit states the defendant conducted three inquiries and approved him, but the plaintiff claims he was never notified that his application was approved. In March, the suit states the plaintiff requested that his application be canceled but was informed that his deposit will not be returned because he did not sign the lease within the 24 hours from the approval date.

The plaintiff holds The Enclave Apartment Homes Trinity Property Consultants responsible because the defendant's inquiries to the three credit reporting agencies and their published reports allegedly were false constitute libel per se.

The plaintiff requests a trial by jury and seeks judgment for general, special, exemplary and punitive damages, attorney's fees, cost of suit, and for such other and further relief as the court may deem just and proper. He is representing himself.
