Woman alleges she was injured by glass in drink at Pismo's Coastal Grill

FRESNO – A patron of a Fresno restaurant alleges broken glass in her drink caused a tear in her esophagus.

Maria Villegas-Clark filed a complaint on May 22 in the Fresno County Superior Court against Pismo's of Fresno, doing business as Pismo's Coastal Grill; David Fansler; and Does 1-50 alleging strict product liability, negligence and other counts.

According to the complaint, the plaintiff alleges that on May 29, 2015, plaintiff with her mother went into premises of the defendants and claims that broken glass was served in her drink, which she discovered after she had consumed some of it. She alleges she sought medical treatment and was told there was a tear in her esophagus. The suit states the glass has not been removed from her body and that she was told surgery to remove it would be risky.

The plaintiff holds the defendants responsible because they allegedly failed to implement or non-negligently perform inspection and monitoring of the product or product-ingredients to prevent contamination.

The plaintiff requests a trial by jury and seeks judgment for general damages; medical, hospital, and related expenses; loss of earnings, punitive damages; cost of suit; and for such other and further relief as the court may deem proper.
