LOS ANGELES – A Michigan corporation alleges that a Folsom business is unlawfully using its trademark.
Wesley Corp. filed a complaint on June 16 in the U.S. District Court for the Eastern District of California against SJS Commercial LLC and Does 1 through 10 alleging trademark infringement, false or misleading statements in advertising goods, patent infringement and other counts.
According to the complaint, the plaintiff is the owner of the Stufz trademark. The plaintiff holds SJS Commercial LLC and Does 1 through 10 responsible because the defendants allegedly adopted and used plaintiff's mark to advertise their goods.
The plaintiff seeks defendants' profits, damages, exemplary and treble damages, interest, all legal fees and any other relief as the court deems just. It is represented by Frank Frisenda of Frisenda, Quinton & Nicholson in Los Angeles.
