Class action filed against Smartpay Leasing Inc. over allegedly unwanted text messages

SAN DIEGO – An Arizona resident alleges that a lease-to-own payment plan company based in San Francisco unlawfully sent her messages.

Shawn Esparza filed a complaint on behalf of all others similarly situated on June 13 in the U.S. District Court for the Northern District of California against Smartpay Leasing Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she began receiving several unwanted text messages from the defendant in September 2016. The plaintiff holds Smartpay Leasing Inc. responsible because the defendant allegedly sent unsolicited text messages to the plaintiff without her consent.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages and any other relief as the court deems just. He is represented by Ronald A. Marron, Alexis Wood and Kas Galluci of Law Offices of Ronald A. Marron in San Diego.
