LOS ANGELES – The maker of male enhancement product Powerful Desire alleges a competitor is selling unlawful products that contain prescription drugs using false and misleading advertising.
JST Distribution LLC filed a complaint on June 15 in the U.S. District Court for the Northern District of California against Gadget Island Inc., doing business as Gearisle.com, and Does 1 through 10 alleging false advertising.
According to the complaint, the plaintiff alleges the defendant sells male enhancement products 5K, Alpha Male and others that contain sildenafil, the active ingredient in Viagra. The plaintiff claims that the defendant falsely states its products are all natural and contain no harmful synthetic chemicals.
The plaintiff seeks to enjoin the defendant, compensatory damages, profits, restitution, treble damages, punitive damages, all legal fees and any other relief as the court deems just. It is represented by Robert Tauler of Tauler Smith LLP in Los Angeles.
