Alltrade Tools alleges it does not infringe Quality Craft Industries toolbox trademark

LOS ANGELES – A Cypress tools and equipment manufacturer is seeking declaratory judgment regarding a Missouri company's claims of patent infringement.

Alltrade Tools LLC filed a complaint on June 15 in the U.S. District Court for the Central District of California against Quality Craft Industries Inc. seeking declaratory judgment.

According to the complaint, the plaintiff alleges that on May 10, plaintiff was sent a cease and desist letter from the defendant asserting that the plaintiff's product, the Mastergrip Toolbox, is an infringed product of the defendant's trademarked product. Plaintiff claims that its products are not likely to cause confusion with the product designs of the defendant's '484 trademark due to its alleged different design, shape and function. 

The plaintiff requests a trial by jury and seeks a declaration that the Mastergrip Toolbox does not infringe upon QCT's trademark, grant all monetary relief and grant further relief as the court deems appropriate. It is represented by Gary Anderson and David J. Pitman of Fulwider Patton LLC in Los Angeles.
