Consumer claims MCT Group, individual used unconscionable means to collect debt

SAN DIEGO – A San Diego County consumer alleges that a debt collector made false and misleading misrepresentations regarding the collection of a debt.

Lawrence Sparks filed a complaint on June 13 in the U.S. District Court for the Southern District of California against USE Credit Union; MCT Group Inc., doing business as MCT Group; and Jason Travis Bulpitt, formerly known as Travis Bulpitt and Jason Russell, alleging that the defendants violated the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that he received calls from defendant Bulpit in behalf of defendant MCT Group regarding an alleged debt. The suit states Bulpit told the plaintiff in September 2016 he would lose his business if he did not begin making payments immediately of $200 per month. As a result, Sparks claims he suffered fear, depression and emotional turmoil. 

The plaintiff holds the defendants responsible because they allegedly made false, deceptive or misleading misrepresentation in the collection of a debt and used unfair or unconscionable means to collect or attempt to collect a debt.

The plaintiff requests a trial by jury and seeks to award actual damages, statutory damages of $1,000, costs of litigation, attorney's fees, and such other and further relief the court may deem just and proper. He is represented by Stephen G. Recordon of Recordon & Recordon in San Diego.
