SACRAMENTO – A Rocklin consumer alleges that a debt collector abusively tried to collect an alleged debt from her.
Stacie Hart filed a complaint on June 23 in the U.S. District Court for the Eastern District of California against D. Scott Carruthers, a professional corporation and SFM-6 LLC citing the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, an alleged debt belonging to the plaintiff was assigned to the defendants for collection in November 2016. The plaintiff holds D. Scott Carruthers and SFM-6 LLC responsible because the defendants allegedly discussed the alleged debt with her father and co-workers and contacted her at work despite being told that her employer prohibited such calls.
The plaintiff seeks actual damages, statutory damages of $1,000, all legal fees, and any other relief as the court deems just. She is represented by Crosby S. Connolly and Robert L. Hyde of Hyde & Swigart in San Diego.
