Ross Stores, Novelle Mode accused of unlawfully copying textile design

LOS ANGELES – A Los Angeles corporation claims one of its textile designs was copied without authorization.

Neman Brothers & Assoc. Inc. filed a complaint on June 22 in the U.S. District Court for the Central District of California against Novelle Mode Inc., doing business as Free Kisses; Eun S. Kim; Ross Stores Inc., doing business as DD'S Discounts; and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its Hi-Summer Prints/Studio Artwork 2010 fabric design copied. The plaintiff holds the defendants responsible because the defendants allegedly sold or manufactured garments made out of fabrics that bear plaintiff's design.

The plaintiff requests a trial by jury and seeks enjoin the defendant, profits, statutory damages, all legal fees, interest and any other relief as the court deems just. It is represented by C. Yong Jeong, Amy Choe and John R. Baldivia of Jeong & Likens LC in Los Angeles.
