BNSF Railway utility herder alleges he was injured on the job because of unsafe coupler

FRESNO – A worker at the Fresno-Calwa rail yard alleges that he was injured because of an unsafe and inoperative coupler on a rail car.

Jose A. Garza filed a complaint on June 7 in the Fresno County Superior Court against BNSF Railway Co. and Does 1-2 citing the Federal Employers' Liability Act.

According to the complaint, the plaintiff alleges that on Oct. 14, 2015, he was acting in the course and scope of his employment with defendant as a utility herder when he was caused to suffer injuries to his shoulder.

The plaintiff requests a trial by jury and seeks judgment against defendant for general and special damages, costs of suit, interest and such other relief that the court may deem proper and appropriate. He is represented by Anthony S. Petru and Paula A. Rasmussen of Hildebrand McLeod & Nelson LLP in Oakland.
