Sushi Sweets accused of infringing Cupcake Sushi marks, patents

LOS ANGELES – A Mission Viejo bakery, its owner and chef are accused of wrongfully using the Cupcake Sushi mark and design.

Cupcake Sushi LLC and Lori Shubert filed a complaint on June 21 in the U.S. District Court for the Central District of California against Jamie Speirs; Michael Santiago; Baturhan Corabatir; Batuser Inc., doing business as Sushi Sweets; and Does 1 through 25 alleging patent and trademark infringement.

According to the complaint, Cupcake Sushi LLC and Shubert are the registered owner of the Cupcake Sushi patents and trademark. The suit states the defendants are not affiliated with the plaintiffs or authorized in any way to advertise, promote or sell Cupcake Sushi dessert products or related services.

The plaintiffs hold Speirs, Santiago, Corabatir, Batuser Inc. and Does 1 through 25 responsible because the defendant allegedly misappropriated plaintiffs' intellectual property.

The plaintiffs seek preliminary and permanent injunction, attorney's fees and cost, exemplary damages and any such other and further relief as the court deems just and proper. They are represented by Tracy Neal Lopez of Neal Lopez Law Group PC in Long Beach.
