Omnitracks LLC alleges Blue Dot Solutions used trade secrets to develop competing product

SAN DIEGO – A Dallas company alleges that a Denver corporation developed a competing fleet management system from its confidential information.

Omnitracks LLC filed a complaint on June 19 in the U.S. District Court for the Southern District of California against Blue Dot Solutions Inc. alleging misappropriation, breach of contract, tortious interference, misrepresentation and other counts.

According to the complaint, the plaintiff alleges that on Feb. 8, 2011, plaintiff contracted with the defendant and entered into a Master Services Agreement to develop a suite of out-of-cab software applications that Omnitracs calls Extended Productivity. 

Under the MSA, defendant allegedly agreed that all information provided related to its operations and intellectual property by plaintiff will be confidential. Plaintiff claims that despite agreeing with MSA contract, plaintiff's confidential information was used without authorization for another competing fleet management system by the defendant. 

The plaintiff requests a trial by jury and seeks preliminary and permanent injunction to prohibit the use of plaintiff's confidential information; actual, punitive and exemplary damages; pre- and post-judgment interest; costs of suit; and such other further relief as the court may deem just and proper.
