LOS ANGELES – An insurance company is seeking more than $9,000 in damages from three common carriers over allegations cargo was damaged while in transport.
Sompo Japan Insurance Co. of America filed a complaint on June 26 in the U.S. District Court for the Central District of California against Orient Overseas Container Line LTD, Dynamic Worldwide Logistics Inc. and Does 1 through 10 alleging damage to cargo, negligence, breach of contract and declaratory relief.
According to the complaint, the defendants received a shipment of auto parts to be transported from Vietnam to Los Angeles in June 2016. The suit states the defendants failed and neglected to carry and deliver the cargo in the good order in which it was received. The plaintiff states it mitigated the loss by a settlement of $9,500.
The plaintiff holds Orient Overseas Container Line LTD; Dynamic Worldwide Logistics Inc. and Does 1 through 10 responsible because the defendants allegedly failed to deliver the cargo in the same condition it was received.
The plaintiff requests a trial by jury and seeks damages of $9,500, interest, all legal fees and any other relief as the court deems just. It is represented by Dennis A. Cammarano of Cammaarano Law Group in Long Beach.
