Tokio Marine & Nichido Fire Insurance seeks more than $250,000 for allegedly damaged printers

LOS ANGELES – Two common carriers are facing a suit from an insurer after a shipment of printers was allegedly damaged in transport.

Tokio Marine & Nichido Fire Insurance Co. LTD filed a complaint on June 26 in the U.S. District Court for the Central District of California against Mitsui O.S.K. Lines LTD, BNSF Railway Co. and Does 1 through 10 alleging negligence, breach of contract and other counts.

According to the complaint, Mitsui and Does received a shipment of business printers in May and June 2016 to transport from Japan to Indiana through Long Beach/Los Angeles. Mitsui tendered the cargo to BNSF in June 2016 for carriage from California to Chicago, the suit states.

The plaintiff holds Mitsui O.S.K. Lines LTD, BNSF Railway Co. and Does 1 through 10 responsible because the defendants allegedly failed to deliver all of the cargo in perfect condition, causing damage to the plaintiff of more than $250,000.

The plaintiff seeks general damages of $251,371, interest, all legal fees and any other relief as the court deems just. It is represented by Dennis A. Cammarano of Cammarano Law Group in Long Beach.
